Trademark Renewal Service in the Philippines

Duran & Duran-Schulze Law offers services  regarding trademark matters and intellectual property law. We ensure that your trademark renewals are handled efficiently.

Under Section 146 of the Intellectual Property Code of the Philippines, a trademark registration certificate can be renewed for an additional ten (10) years once it expires. The renewal application can be submitted up to six (6) months before the registration ends or within six (6) months after its expiration, although a late fee will apply if renewed after expiration. In addition, if the trademark owner fails to renew it, the protection it has is no longer valid.

Importance of Trademark Renewal

As an entrepreneur, renewing a trademark is essential because of the following reasons:

  • Helps the company to maintain its market presence and brand identity by granting the trademark owner an exclusive right to use the mark for their goods or services;
  • Protects the company’s brand and from unauthorized misuse;
  • Prevents others from capitalizing on the trademark owner’s established reputation; and
  • Ensures that the trademark remains active and prevents it from being abandoned due to non-use, which could result in losing rights to the mark.
