In the Philippines, registrable marks include word marks, visual (figurative) marks, combined word and image marks, 3D marks for product shapes or packaging, and stamped or marked containers.
Not all marks can be registered. Trademarks that are immoral, deceptive, scandalous, use official symbols, or include a living person’s name or image without consent are prohibited. Marks that are generic, confusingly similar to existing or well-known trademarks, or lack distinctiveness also cannot be registered.
A registered trademark in the Philippines is valid for 10 years and can be renewed for an additional 10-year period.
You may still revive the trademark within a grace period by paying additional fees, but delays can expose your brand to risk.
