Correction of Clerical Error in Birth Certificate

In the Philippines, to legally correct your name or the clerical errors is to file a petition at the Local Civil Registry Office, which holds the documentation bearing your original name, where your Civil Registry document is registered. The petition can be filed by anyone with a direct and personal interest in the correction.

This is governed by Republic Act NO. 9048.

What Should I Do if I Have Two (2) Birth Certificates?

When a certificate of live birth is registered twice or more with the PSA, the first registration date or earlier – remains, and must be given to the concerned person requesting such registry entry.

Your remedy in this kind of situation is to have one registry entry canceled by filing a Petition for Cancellation of Civil Registry Entry before the Regional Trial Court that has jurisdiction over the Local Civil Registry Office where your certificate of live birth is registered, ie. where you were born.

If the change involves substantial errors or cancellation of entries in the Civil Registry documents, the way to do is the by filing a petition before the Local Civil Registry Office where the Civil Registry document(s) is registered, and can be filed by any person interested in any act, event, order or decree concerning the change or cancellation.

This is governed by Rule 108 of the Revised Rules of Court.
