What is Child Support?

In the Philippines, the concept of child support holds both legal significance and moral obligation, forming a vital part of the parental duty to nurture and provide for their children.

Article 194 of the Family Code of the Philippines defines support as “everything indispensable for sustenance, dwelling, clothing, medical attendance, education and transportation in keeping with the financial capacity of the family.

In Del Socorro v. Van Wilsem, the Supreme Court held that “the obligation to give support to a child is a matter that falls under family rights and duties.” 

How to Get a Child Support? 

The obligation to give support shall be demandable from the time the person, who has a right to receive the same, needs it for maintenance, but it shall not be paid except from the date of judicial or extrajudicial demand (Sy v. CA, G.R. No. 124518).

In the Philippines, child support is crucial in ensuring that children receive the necessary financial assistance to meet their basic needs and educational expenses. In cases where the parents are separated or divorced and the children live with one parent, the non-custodial parent is typically responsible for providing child support. However, if the non-custodial parent refuses to pay or there is a dispute regarding the amount, the custodial parent can seek legal recourse through the court system.

When determining child support, the court takes various factors into consideration, including the income of both parents, the child’s needs, and the relationship between the parents and the child. The court may also consider the child’s birth certificate as evidence of the parent-child relationship.
