Annulment in the Philippines

What is Annulment?

On March 15, 2003, the Supreme Court of the Philippines promulgated the New Rule on Declaration of Absolute Nullity of Void Marriages and Annulment of Voidable Marriages, thereby legalizing annulment in the Philippines.

Annulment is a legal procedure that declares a marriage null and void, and the petitioner must provide evidence supporting why their marriage should be annulled. According to the Family Code of the Philippines, common grounds for annulment include psychological incapacity, fraud, force, intimidation, or undue influence.

Apart from annulment, the spouses can put an end to their union or marriage by filing for any of the following remedies:

  • Declaration of Nullity of Marriage
  • Legal Separation
  • Divorce (when one of the spouse is a non-Filipino citizen, and which requires the Foreign Recognition of thereof in Philippine Courts)
