Dear Atty. Duran-Schulze,
Can I file a petition for annulment of marriage without appearing in the court? Also how long will the process take until a decision is granted?
Dear Writer,
No, you can’t file a petition for annulment without appearing before the court. The Philippine court requires the litigant to testify in person and that his/her/their interests are adequately represented.
If you are unable to attend, you must notify the court and request a rescheduling to protect your rights and ensure your participation in the proceedings. If you are outside of the country, you can request that the hearing be scheduled and/or conducted at the nearest embassy or consulate of the Philippines via video conference hearing.
Additionally, the annulment process in the Philippines can take an average of two (2) years or even longer, depending on the complexity of the case, the availability of the parties and their lawyers, and the schedule of the court.
