Chinese National Spouse Visa (MCL-07-021)

The Memorandum Order No. MCL-07-021 was duly approved by the Secretary of Department of Justice on December 14, 2007. In accordance with MCL-07-021, a Chinese national who is legally married to a Filipino spouse is granted to secure a Permanent Residence Visa in the Philippines. In this regard, the Filipino spouse may claim his or her legal Chinese spouse and their legitimate child/children who are under twenty-one (21) years old as dependents. This process requires the submission of specific documents to the Philippine Foreign Service Post. By providing the necessary documentation, Filipino citizens can ensure that their foreign spouse and children receive the benefits and recognition accorded to dependents under Philippine law.

Process for a Chinese National Spouse Visa (MCL-07-021)

To obtain a Chinese Spouse Visa, the Filipino spouse must file a petition for his/her spouse. A photocopy of the foreign spouse’s passport indicating dates of arrival and authorized stay, and their Marriage Certificate must be submitted. If the marriage took place outside the Philippines, the certificate must be authenticated by the Philippine Embassy or Consulate in the relevant location. Additionally, the applicant must also submit the PSA Birth Certificate of his/her Filipino spouse and their minor child/children, BI clearance, and payment of the application and express lane fees. 

Furthermore, the Office of the Commissioner or its authorized representative will assess the application. If a hearing is required, a notice will be sent by registered mail to the petitioner and applicant’s provided address. Otherwise, the application will be forwarded to the Commissioner or the Board of Commissioners for further action.
